Terms of the hetmancapital.com website and the Hetman Capital Club community. Effective from: 2026-10-22. This is a translation of the Polish version, which prevails in case of any discrepancy.

§ 1. General provisions and definitions

  1. Provider: JDN Justyna Dawidowicz, Moderska 12A, 62-062 Strykowo, NIP 7773356501, trading as Hetman Capital. Contact: [email protected].
  2. Website: the website at hetmancapital.com.
  3. Club: the Hetman Capital Club online community at club.hetmancapital.com, operating on the Circle platform (Circle.so, Inc.), including its mobile apps.
  4. User: anyone using the Website or the Club.
  5. Member: a User who has created a Club account. Paid Member: a Member who has purchased a Membership.
  6. Membership: paid access to the paid part of the Club under the selected plan (e.g. a monthly or 3-month subscription), as described on the checkout page.
  7. Consumer: a natural person entering into a contract not directly related to their business or profession. Consumer provisions also apply to a sole trader where the contract is not of a professional nature for them (Art. 38a of the Polish Consumer Rights Act).
  8. These Terms are the terms of providing electronic services within the meaning of the Polish Act of 18 July 2002 on Providing Electronic Services. Every User must comply with them.

§ 2. Website services

  1. The Provider offers the following free services on the Website: browsing content, a contact form, and links to social media channels and the Club.
  2. The agreement to use the Website is concluded when you open the Website and ends when you leave it. The agreement to use the contact form is concluded when you send a message and expires once a reply is given.
  3. Technical requirements: a device with internet access, an up-to-date web browser with JavaScript enabled and, for the form, an active e-mail address.
  4. Users must not provide unlawful content.

§ 3. Hetman Capital Club

  1. The Club consists of a free zone, available after creating an account, and a paid part available with a Membership. The current scope of each zone and plan is described in the Club and on the checkout page.
  2. The Membership may include in particular: pre-market analysis, live streams of trading sessions and their replays, educational materials and courses, and discussion spaces. Content is available in Polish. One-to-one mentoring is a separate service described in § 4a.
  3. Creating a Club account requires accepting these Terms and the Circle platform terms. Accounts are personal and must not be shared.
  4. The Provider may develop and change the Club content, provided this does not materially reduce the service paid for by a Paid Member in the current billing period.
  5. Technical requirements for the Club: a device with internet access and an up-to-date web browser or the Circle app (iOS, Android, desktop), an active e-mail address; a connection of at least 5 Mbps is recommended for live streams.
  6. Members may delete their Club account at any time (account settings) or ask for it at [email protected]. Deleting a free account ends the contract for using the Club. Deleting an account does not release the Member from paying for the current, already paid Membership period, subject to § 5.

§ 4. Contract, prices and payments

  1. Membership is available in the following plans: Club, Club Plus and Mentor (bought on the Club checkout page) and Mentor Unlimited (§ 4a). Each plan includes the full scope of the plan below it. The scope and prices of the plans are described at hetmancapital.com/cennik and on the checkout page. The free area (Club Free) requires no payment.
  2. The Club, Club Plus and Mentor plans can be paid monthly, for 3 months or for a year; the period and price are shown before payment. Discounts for longer periods do not apply to Mentor Unlimited.
  3. The Membership contract is concluded upon successful payment for the chosen plan on the Club checkout page.
  4. Prices are shown on the checkout page and are gross prices. Before paying, the User sees the total price including the applicable VAT, the billing period and information about subscription renewal.
  5. Payments are processed by Stripe Payments Europe, Ltd. (payment cards and other methods offered at checkout). The Provider does not store card data.
  6. The subscription renews automatically for the next billing period, and the fee is charged in advance at the start of each period unless the Member cancels beforehand.
  7. A Member may cancel the Membership at any time in their Club account settings or by writing to [email protected]. Cancellation takes effect at the end of the paid period, until which access remains active, subject to § 5.
  8. The Provider will notify Paid Members of any price change by e-mail at least 14 days before the new billing period. A Member who does not accept the change may cancel before it takes effect.
  9. On individual request, the Provider may allow a one-time payment for access to the paid part of the Club for a fixed period (e.g. 30 or 90 days), in particular by BLIK or bank transfer via Przelewy24 (a Polish payment provider operated by PayPro S.A.). Such access does not renew automatically and expires at the end of the paid period. Before paying, the User is informed of the price and access period.
  10. An invoice or receipt is issued on request.

§ 4a. Mentor and Mentor Unlimited plans

  1. Mentoring is a paid educational service. It covers working method, keeping a journal, decision psychology and reading order flow. The Service Provider does not send signals or instructions to enter transactions (“enter here, stop there”) for the Participant’s account and does not manage the Participant’s funds, as that would be investment advice requiring authorisation from the Polish regulator (KNF). The Participant makes investment decisions independently.
  2. The Mentor plan includes the scope of the Club Plus plan and one online group meeting with the mentor every week (about 60 minutes). The meeting time is announced in the Club in advance; an unused meeting does not carry over to the next week.
  3. The Mentor Unlimited plan includes the scope of the Mentor plan and one-to-one mentoring on the following terms: (a) contact through a private channel in the Club on business days between 9:00 and 22:00 Polish time, with no limit on the number of messages; (b) a reply within 2–4 hours outside live-stream hours, and after the stream during a live stream; (c) video calls with no limit on their number, booked at least 24 hours in advance, at times available in the Service Provider’s calendar; (d) ongoing review of the Participant’s trades and journal and a personal development plan.
  4. The Mentor Unlimited plan is available only after a qualifying call (about 15 minutes) following an application through the contact form. Before payment, the Service Provider sends the Participant an e-mail confirming the scope, price and contact rules. The contract is concluded upon payment for the plan. The plan is billed monthly, with no discounts for longer periods.
  5. Plan prices are given at hetmancapital.com/cennik and hetmancapital.com/mentoring. § 4, § 5 (right of withdrawal), § 6 (no investment recommendations) and § 9 (complaints) apply accordingly to the Mentor and Mentor Unlimited plans.

§ 4b. Affiliate programme

  1. Any User with a Club account may join the affiliate programme by expressing interest in the way described in the Club (a comment under the “Affiliate programme” post in the Start here space) and accepting the invitation to the programme on the Circle platform.
  2. The Partner receives a commission of 25% of payments for the Club, Club Plus and Mentor plans made by people who joined through the Partner’s affiliate link: on the monthly plan from the first 6 payments, on the 3-month plan from the first 2 payments, on the annual plan from the first payment. The commission does not cover the Mentor Unlimited plan.
  3. The commission becomes due 30 days after the payment and is not payable on payments refunded within that period. It is paid out via PayPal. The Partner is responsible for the tax treatment of commissions received.
  4. The Partner may not promise profits, present the Club as investment advice or a source of signals, run paid advertising on the name “Hetman Capital”, send spam or refer themselves. Every publication with an affiliate link must be labelled as advertising or a partnership.
  5. If these rules are breached, the Provider may exclude the Partner from the programme; commissions on payments obtained in breach of the rules are not payable. The Provider may change the programme terms with at least 14 days’ notice; the change does not affect commissions already due.

§ 5. Right of withdrawal

  1. A Consumer may withdraw from the Membership contract within 14 days of its conclusion without giving any reason, by sending a statement, e.g. to [email protected]. Sending the statement before the deadline is sufficient.
  2. If the Consumer requested that the service start before the end of the withdrawal period and then withdraws, they will pay an amount proportionate to the service provided up to the moment of withdrawal (Art. 35 of the Polish Consumer Rights Act). The remainder of the payment will be refunded.
  3. Refunds are made without undue delay, no later than 14 days after receiving the statement, using the same payment method unless the Consumer agrees otherwise.
  4. The Consumer may use the following model withdrawal form, but it is not obligatory:
“To: JDN Justyna Dawidowicz, Moderska 12A, 62-062 Strykowo, NIP 7773356501, [email protected]. I/We hereby give notice that I/we withdraw from my/our contract for the Hetman Capital Club Membership service. Contract concluded on: … Name: … Account e-mail: … Date: …”

§ 6. Nature of the content: no investment advice

  1. All content on the Website and in the Club, including streams, analyses, comments and educational materials, is for educational and informational purposes only. It does not constitute investment recommendations, investment, tax or legal advice, an offer or a solicitation to buy or sell financial instruments.
  2. The Provider is not a licensed investment adviser. The decisions shown are the presenter’s own and are not tailored to any User’s situation.
  3. Trading financial instruments, especially leveraged futures, carries a high risk of losing some or all of your capital. Past performance does not guarantee future results. Users make decisions independently and at their own risk.

§ 7. Community rules

  1. In the Club it is forbidden in particular to: post unlawful, offensive or misleading content; spam or advertise without the Provider’s consent; offer paid signals, management of other people’s capital or “guaranteed profits”; impersonate others; record, copy or distribute paid content outside the Club; share an account with third parties.
  2. Paid content may contain visible or invisible markings (e.g. a watermark) that make it possible to identify the account it was shared from. The Provider monitors unauthorised distribution of its content online, including in messaging apps and social networks, reports infringements to the administrators of those services and may pursue claims for copyright infringement.
  3. If these Terms are breached, the Provider may remove content, temporarily suspend the account and, in the case of a serious or persistent breach after a prior warning, terminate the contract with immediate effect. A Consumer is then entitled to a proportionate refund for the unused period.

§ 8. Copyright

Content provided by the Provider is protected by copyright. Members receive a non-exclusive, non-transferable right to use it for personal purposes only for the duration of their Membership. Content posted by Members remains theirs. Members grant the Provider a free licence to display it in the Club to the extent necessary for the community to function.

§ 9. Complaints

  1. Complaints about the Website or the Club, including lack of conformity of the digital service with the contract, can be sent to [email protected]. Please describe the problem and include your account e-mail address.
  2. The Provider responds to complaints within 14 days of receipt. For Consumers, digital services are governed by Chapter 5b of the Polish Consumer Rights Act.

§ 10. Liability

  1. The Provider makes every effort to keep the Website and the Club running without interruption, but is not liable for interruptions caused by third-party providers (e.g. Circle, Stripe, streaming platforms) or for technical breaks announced in advance.
  2. The Provider is not liable for Users’ investment decisions or their financial consequences (see § 6).
  3. These exclusions do not limit Consumers’ rights under mandatory provisions of law.

§ 11. Personal data

Personal data processing is described in the Privacy Policy.

§ 12. Dispute resolution

Consumers may use out-of-court complaint and redress procedures, including help from municipal or district consumer ombudsmen and the regional Trade Inspection offices in Poland (information at uokik.gov.pl), or the consumer bodies in their country of residence.

§ 13. Final provisions

  1. The Provider may amend these Terms for important reasons (changes in law, changes in the scope of services, security reasons). Paid Members will be informed of changes by e-mail at least 14 days in advance. A Member who does not accept the changes may cancel the Membership before they take effect.
  2. Polish law applies to matters not covered here. This choice of law does not deprive Consumers of the protection granted by the law of their country of habitual residence.
